1. Agreement Overview
1.1 Introduction
These Terms and Conditions (“Terms”) form a legally binding agreement between you and Bhoomi governing your use of Bhoomi’s business software, online platforms, and related services (“Services”). By creating a Bhoomi account or continuing to use the Services, you acknowledge and agree to comply with these Terms.
1.2 Updates to the Agreement
Bhoomi may update these Terms at any time. Updated versions will be posted on our website and notice of material changes will be provided. Continued use of the Services after updates become effective constitutes acceptance of the revised Terms.
2. Arbitration and Dispute Resolution (U.S. Residents Only)
2.1 Binding Arbitration
If you reside in the United States or your business is primarily located there, the following applies:
- Informal Resolution: Both parties agree to attempt informal resolutions for 60 days after receiving a Notice of Dispute.
- Mandatory Arbitration: Unresolved disputes must be submitted to binding individual arbitration administered by the American Arbitration Association (“AAA”) under the Federal Arbitration Act (“FAA”).
- No Court Proceedings: You waive the right to bring claims in court before a judge or jury, except for small claims court matters.
- Class Action Waiver: Class actions, class arbitrations, representative actions, and private attorney general actions are prohibited.
- Individual Proceedings Only: Consolidation of claims is allowed only with written consent from all parties.
2.2 Scope of Arbitration
These provisions apply to all disputes arising from or relating to these Terms, the Services, or associated software. References to “Bhoomi,” “we,” “”our, or “us” include Bhoomi and its affiliates.
3. Account Management
3.1 Account Creation
You must provide accurate, complete, and truthful information when creating a Bhoomi account. Submitting false or misleading information is prohibited.
3.2 Account Requirements
- Active Subscription: Required to maintain account access.
- Age Requirement: You must be of legal age in your jurisdiction or have verified parental/guardian consent.
- Parental Responsibility: Parents/guardians are responsible for all activity under accounts created for minors.
3.3 Account Closure
By You
You may cancel Services or close your account at any time through the Contact Us form after logging into your tenant.
- 30 Day Pause Option: You may pause your account for up to 30 days before permanent closure.
- New Account Required: Once closed, a new account must be created to resume Services.
Consequences of Closure
- Immediate loss of access to all Services
- Deletion or disassociation of your data (unless legally required to retain)
- Loss of access to subscribed or purchased products
4. Tenant Storage
Each tenant receives 25 GB of shared storage across all users. Additional storage may be purchased as needed.
5. Privacy and Data Protection

The Bhoomi Privacy Statement explains:
- Types of data collected
- How data is used
- Legal bases for processing
- How your content is handled
5.2 Consent
By using the Services, you consent to Bhoomi’s collection and processing of your data as described in the Privacy Statement.
6. User Content and Intellectual Property
6.1 Ownership of Content

6.3 License Granted to Bhoomi
You grant Bhoomi a worldwide, royalty free license to use your content solely to:
- Provide and improve the Services
- Protect users and the platform
- Maintain and enhance Bhoomi products
6.4 Advertising Policy
Bhoomi does not use your personal files (emails, chats, documents, photos, etc.) for targeted advertising.
7. Code of Conduct
7.1 Prohibited Activities
You agree not to engage in or facilitate:
- Illegal Activities: Including exploitation or harm to children
- Harmful Communications: Spam, phishing, malware, harassment, hate speech, threats
- Fraudulent Behavior: Misrepresentation, impersonation, manipulation of Services
- Technical Violations: Circumventing security, unauthorized access, AI jailbreak attempts
- Privacy Violations: Infringing intellectual property or privacy rights
You may not assist others in violating these rules.
8. Service Usage and Support
8.1 Service Requirements
You are responsible for all equipment, internet access, and data plans required to use the Services.
8.2 Notifications
Service notifications may be sent via email or SMS. Standard messaging rates may apply.
8.3 Customer Support

- Technical Support: Available to subscribers via the admin panel
- Limitations: Support may not be available for beta or preview features
8.4 Content Moderation
Bhoomi may block or remove content that violates these Terms. Violations may be reported at https://bhoomiapp.com/contact-us/.
8.5 Service Termination
Upon cancellation:
- Access to Services ends immediately
- Software licenses terminate
- Data may be deleted or disassociated
- Access to purchased products may be lost
9. Third Party Services
9.1 Integration
The Services may integrate with third party applications or websites.
9.2 Third Party Terms
Use of third party services is governed by their own terms and privacy policies.
9.3 Assumption of Risk
You assume all risks associated with third party services. Bhoomi is not responsible for issues arising from their use.
10. Software License
10.1 SaaS Model
The Bhoomi App is provided as a subscription based SaaS solution. It is not sold or licensed to you.
10.2 Restrictions
You may not:
- Circumvent security protections
- Reverse engineer or decompile the software
- Rent, lease, sell, or transfer access rights
- Interfere with others’ use of the Services
11. Payment Terms
11.1 Charges and Taxes
You must pay all applicable charges. Prices exclude taxes unless stated otherwise.
11.2 Payment Methods
Accepted methods include credit and debit cards. You must be authorized to use the payment method.
11.3 Billing Process
Charges may be billed in advance, at purchase, or on a recurring basis. Notice will be provided for subscription price changes.
11.4 Subscription Services
Subscriptions renew automatically until canceled. Fees are charged in advance.
11.5 Billing Statements and Errors
Billing statements are emailed. Errors must be reported within 90 days.
11.6 Refund Policy
All purchases are final unless required by law. Subscription cancellations take effect at the next billing cycle.
11.7 Service Cancellation
You may cancel Services at any time. Pending charges may be refunded on a pro rated basis.
11.8 Trial and Promotional Offers
A 30 day free trial is available for primary accounts. Promotional terms may vary.
11.9 Price Changes
Bhoomi may modify pricing at any time with advance notice.
12. Service Availability and Updates
12.1 Availability
Services may be unavailable or vary by region. Bhoomi is not liable for outages or disruptions.
12.2 Software Updates
Updates may be automatically installed and may be required to continue using the Services.
12.3 Service Changes
Bhoomi may modify or discontinue features at any time.
13. Legal Provisions
13.1 Governing Law
For U.S. residents, these Terms are governed by the laws of your state of residence and the FAA for arbitration matters.
13.2 Disclaimer of Warranties
The Services are provided “as is,” “with all faults,” and “as available.” Bhoomi makes no warranties of any kind.
13.3 Limitation of Liability
Your maximum recovery for direct damages is limited to your monthly service fee (or $10 for free Services). Consequential and punitive damages are excluded to the fullest extent permitted by law.
