"Bhoomi Services Agreement governs your use of Bhoomi’s business online products and services"

1. Agreement Overview

1.1 Introduction

This Bhoomi Services Agreement (“Terms”) governs your use of Bhoomi’s business online products and services (“Services”). By creating a Bhoomi account, using our Services, or continuing to use them after being notified of changes, you accept these Terms.

1.2 Agreement Updates

This published agreement reflects the most current terms. We may update these Terms at any time and will notify you of changes. Continued use after changes become effective constitutes acceptance of the new terms.

2. Arbitration and Dispute Resolution

2.1 Binding Arbitration (US Residents Only)

IMPORTANT: If you live in (or your business is principally located in) the United States, the following arbitration provisions apply:

  • Informal Resolution: We agree to attempt informal resolution for 60 days upon receipt of a Notice of Dispute
  • Binding Arbitration: Unresolved disputes will be submitted to binding individual arbitration through the American Arbitration Association (AAA) under the Federal Arbitration Act (FAA)
  • No Court Proceedings: You agree not to sue in court before a judge or jury, except in small claims court
  • Class Action Waiver: Class action lawsuits, class-wide arbitrations, private attorney-general actions, and representative proceedings are prohibited
  • Individual Proceedings Only: Combining individual proceedings requires consent of all parties

2.2 Scope

These provisions apply to all disputes related to these Terms, the Services, or related software. “We,” “our,” and “us” include Bhoomi and its affiliates.

3. Account Management

3.1 Account Creation

  • You may create a Bhoomi account by signing up online
  • You must provide accurate and truthful information
  • False, inaccurate, or misleading information is prohibited

3.2 Account Requirements

  • Active Use: Maintain an active subscription to keep your account active
  • Age Requirements: You must have reached the age of majority in your location, or have parental/guardian consent
  • Parental Responsibility: Parents/guardians are responsible for all account activity and purchases

3.3 Account Closure

By You:

  • Cancel specific services or close your account at any time
  • Contact us through the Contact Us form after logging into your tenant
  • 30-Day Pause Period: Choose to pause your account for 30 days before permanent closure
  • New Account Required: After closure, you must create a new account to restart services

Consequences of Closure:

  • Immediate loss of access to Services
  • Deletion or disassociation of your data and content (unless legally required to retain)
  • Loss of access to subscribed products

4. Tenant Storage

4.1. When you sign up for a Bhoomi account, the tenant by default gets 25 GB of storge. This amount is the total for all the users in that tenant. Additional storage can be purchased if required.

5. Privacy and Data Protection

5.1 Privacy Statement

Your privacy is important to us. Please review the Bhoomi Privacy Statement, which describes:

  • Types of data we collect from you and your devices
  • How we use your data
  • Legal bases for processing your data
  • How we handle your content

5.2 Consent

By agreeing to these Terms, you consent to Bhoomi’s collection, use, and disclosure of your content and data as described in our Privacy Statement, where processing is based on consent and permitted by law.

6. User Content and Intellectual Property

6.1 Ownership

  • Your Content Remains Yours: We do not claim ownership of your content
  • Your Responsibility: You are responsible for your content
  • Rights Required: You must have all necessary rights for content you upload, store, or share

6.2 Content Sharing

When you share content with others, you understand they may use, save, reproduce, broadcast, transmit, share, and display your content worldwide for the purpose you made it available, without compensation to you.

6.3 License to Bhoomi

You grant Bhoomi a worldwide, royalty-free intellectual property license to use your content as necessary to:

  • Provide Services to you and others
  • Protect you and the Services
  • Improve Bhoomi products and services

6.4 Advertising Policy

We do not use your email, chat, video calls, voice mail, documents, photos, or personal files to target advertising to you.

7. Code of Conduct

7.1 Prohibited Activities

When using our Services, you agree NOT to: Illegal Activities:

  • Engage in illegal activities or generate/share illegal content
  • Exploit, harm, or threaten children
Harmful Communications:
  • Send spam, engage in phishing, or distribute malware
  • Display or generate inappropriate content (nudity, pornography, graphic violence, etc.)
  • Engage in harassment, bullying, hate speech, or threats

Fraudulent Behavior:

  • Engage in fraudulent, false, or misleading activity
  • Impersonate others or create fake accounts
  • Manipulate Services to affect rankings, ratings, or comments

Technical Violations:

  • Circumvent access restrictions or attempt to “jailbreak” AI systems
  • Transmit viruses or engage in unauthorized system access
  • Violate others’ privacy or intellectual property rights

General Rule: Do not help others break these rules.

8. Service Usage and Support

8.1 Service Requirements

  • Internet Connection: You need an internet connection and/or data plan
  • Equipment Responsibility: You provide and pay for all necessary connections, plans, and equipment

8.2 Notifications

We will send service notifications via email or SMS to addresses/numbers associated with your account. Data/messaging rates may apply for SMS notifications.

8.3 Customer Support

  • Sales Support: Available via email or web at https://bhoomiapp.com/contact-us/
  • Technical Support: Available only to subscribers through their admin panel
  • Limitations: Support may not be available for preview or beta features

8.4 Content Moderation

  • Policies: Our Code of Conduct identifies prohibited activities
  • Reporting: Report violations at https://bhoomiapp.com/contact-us/
  • Review Process: We use automated systems and human review for content moderation
  • Enforcement: We may block, remove, or decline content that violates our policies

8.5 Service Termination

If your services are canceled:

  • Immediate loss of access to Services
  • Software license termination
  • Deletion or disassociation of your data and content
  • Loss of access to acquired products

9. Third-Party Services

9.1 Third-Party Integration

Our Services may allow access to third-party websites, applications, or services (“Third-Party Services”).

9.2 Third-Party Terms

  • Review third-party terms and privacy policies before use
  • Third-party terms do not modify these Terms
  • Bhoomi does not license intellectual property as part of Third-Party Services

9.3 Assumption of Risk

You assume all risk and liability from using Third-Party Services. Bhoomi is not responsible for issues arising from their use.

10. Software License

10.1 Software as a Service (SaaS)

The Bhoomi App software is provided as a subscription-based SaaS solution, not licensed or sold.

10.2 Restrictions

You may NOT:

  • Circumvent technological protection measures
  • Disassemble, decompile, decrypt, hack, or reverse engineer the software
  • Separate components for use on different devices
  • Publish, copy, rent, lease, sell, export, import, distribute, or lend the software
  • Transfer software licenses or access rights
  • Use Services in unauthorized ways that interfere with others’ use

11. Payment Terms

11.1 Charges and Taxes

  • Pay all charges associated with your Service usage
  • Prices exclude applicable taxes and currency exchange fees unless stated otherwise
  • Taxes calculated based on your account registration location
  • Service suspension/cancellation may occur for non-payment

11.2 Payment Methods

  • Accepted Methods: Currently accept Credit and Debit cards (additional methods coming soon)
  • Authorization: You must be authorized to use the provided payment method
  • Account Updates: Promptly update billing information and payment method details

11.3 Billing Process

  • Authorization: By providing payment method, you authorize charges for Services
  • Billing Timing: May bill in advance, at purchase, shortly after, or on recurring basis
  • Advance Notice: We’ll notify you of changes to recurring subscription charges

11.4 Subscription Services

  • Recurring Payments: Subscription purchases authorize recurring payments until terminated
  • Cancellation Timing: Cancel before next billing date to stop charges
  • Electronic Payments: Payments processed as electronic debits or credit card charges
  • Advance Billing: Subscription fees charged in advance of service period

11.5 Billing Statements and Errors

  • Email Statements: Billing statements provided via email only
  • Error Reporting: Report billing errors within 90 days of first appearance
  • Investigation: We’ll promptly investigate reported errors
  • Correction Timeline: Billing errors corrected within 90 days when identified

11.6 Refund Policy

  • General Policy: All purchases are final and non-refundable unless otherwise provided by law
  • No refund is provided for any subscription cancelled. The cancelled subscription automatically falls of in the next billing cycle and is not charged.
  • Error Claims: Contact us within 90 days for billing error claims
  • Discretionary Refunds: We may issue refunds at our sole discretion
  • No Obligation: No obligation to issue similar refunds in the future

11.7 Service Cancellation

  • Cancellation Rights: Cancel services anytime with or without cause
  • Process: Contact Bhoomi admin through primary account deletion process
  • Refunds: Pending charges refunded on pro-rated basis
  • Outstanding Dues: Pay any unpaid amounts prior to cancellation
  • Access Loss: May lose account access and accumulated benefits

11.8 Trial and Promotional Offers

  • Trial Period: 30-day free trial for primary account only (additional users excluded)
  • Cancellation Required: Cancel within trial period to avoid charges
  • Promotional Terms: Special offers subject to specific terms and conditions
  • Breach Consequences: May be charged normal rates for promotional offer violations

11.9 Price Changes

  • Change Rights: We may change service prices at any time
  • Notification: Email notification provided for recurring purchase price changes
  • Disagreement: Cancel services before price change takes effect if you disagree
  • Fixed Terms: Fixed-term pricing remains in force for the agreed period

12. Service Availability and Updates

12.1 Service Availability

  • Services may be unavailable, offered for limited time, or vary by region/device
  • Regional changes may require re-acquisition of paid materials
  • Online services experience occasional disruptions and outages
  • No liability for disruptions or inability to retrieve stored content

12.2 Software Updates

  • Automatic Updates: May automatically check and download software updates
  • Required Updates: Updates may be required to continue using Services
  • Update Terms: Updates subject to these Terms unless other terms accompany them
  • No Guarantee: No obligation to provide updates or support for all system versions

12.3 Service Changes

  • Feature Changes: May remove or change features, or stop providing Services
  • No Replacement Obligation: Generally, no obligation to provide re-downloads or replacements
  • Preview Versions: May release preview/beta versions that may not work correctly

13. Legal Provisions

13.1 Governing Law and Jurisdiction

For US Residents:

  • Governing Law: Laws of your state of residence (or principal place of business)
  • Federal Arbitration Act: Governs arbitration provisions
  • Jurisdiction: Exclusive jurisdiction in state or federal courts in Scott County, Minnesota for non-arbitrated disputes

13.2 Warranties Disclaimer

IMPORTANT – NO WARRANTIES: BHOOMI AND ITS AFFILIATES, RESELLERS, DISTRIBUTORS, AND VENDORS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES. SERVICES PROVIDED “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE.”

Excluded Warranties Include:

  • Accuracy or timeliness
  • Merchantability
  • Satisfactory quality
  • Fitness for particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation
  • Security or content preservation

13.3 Limitation of Liability

Damage Recovery Limits:

  • Maximum Recovery: Direct damages up to your monthly service fee (or $10 if services are free)
  • Excluded Damages: Cannot recover consequential, lost profits, special, indirect, incidental, or punitive damages
  • Broad Application: Limitations apply to all claims related to Terms, Services, or related software
  • Maximum Legal Extent: Limitations apply to maximum extent permitted by law
